Parties. Property Credit Pty Ltd (ABN 93 638 329 674) (“Property Credit”) and the agency identified at sign‑up (“Agency”).
Service. Access to Property Credit ID (biometric KYC and liveness checks). We may update features without materially degrading core functionality.
Lawful basis & notices. You must have a lawful basis (including valid, informed consent where required) to process End Users’ personal and biometric information and provide required notices.
Accuracy & lawful use. Submit accurate, lawful data only. Follow all Applicable Laws (including AML/CTF and Privacy Act 1988 (Cth)).
Security. Keep credentials/API keys secure; notify us of suspected compromise.
Restrictions. No surveillance, tracking, discriminatory profiling, or processing of minors’ data without lawful basis; no reverse engineering; no reselling the Service except within your own services; do not use Outputs to train models or build a competing service.
Roles. You determine purposes/means; we process data to provide/support the Service and comply with law.
Biometric information. Used only for verification, fraud prevention and security; not sold.
Sub‑processors. We may use vetted third parties and remain responsible for them; details available on request.
Retention & deletion. Personal and biometric data are retained only as needed to provide the Service and meet legal obligations, then deleted or de‑identified. On termination or written request, we will delete/de‑identify data subject to legal retention duties.
Outputs & decisioning. Outputs are risk signals; you are responsible for decisions and any required human review. No legal/compliance advice is provided.
Availability & support. Commercially reasonable efforts; temporary suspensions for maintenance, emergencies or breach.
Fees & taxes. As set out in the applicable order/pricing, taxes are extra.
IP. We retain all IP in the Service. Licence is limited, revocable and non‑transferable for your internal use.
Liability. No indirect or consequential loss. Aggregate cap is the greater of AUD $10,000 or fees paid in the 12 months before the event, except to the extent liability cannot be limited by law (e.g., fraud or wilful misconduct).
Termination. We may suspend/terminate for breach or risk. Either party may terminate on notice per full Terms. On termination, cease use and delete SDKs/keys (subject to record‑keeping duties).
Governing law. Queensland, Australia; courts of that State/Territory and the Commonwealth.
